Dua Lipa Legal Team Seeks to Unite 'Levitating' Copyright Lawsuits in NYC Court

Dua Lipa's legal team is taking steps to consolidate two copyright infringement lawsuits regarding her hit song "Levitating," which has garnered over two billion Spotify streams.

The first lawsuit, filed in March by members of reggae band Artikal Sound System in California, claims "Levitating" copied elements from their 2017 song "Live Your Life" without permission. The plaintiffs argue that given the similarities, independent creation is "highly unlikely."

The second lawsuit, filed in New York federal court, alleges "Levitating" is "substantially similar" to two songs: Cory Daye's 1979 "Wiggle and Giggle All Night" and Miguel Bosé's 1980 Spanish-language track "Don Diablo."

Dua Lipa's attorneys have contested these claims, stating in their motion to dismiss that the songwriters never heard the compositions in question. They argue that any similarities are merely "unprotectible" basic musical elements, such as descending scales and common clave rhythms.

Recent filings show that Dua Lipa's legal team has filed a motion to transfer the California case to the Southern District of New York, aiming to consolidate both lawsuits in a single forum. The motion was filed on November 14, 2022, and updates on its status are pending.
