Warner Music Settles Patent Dispute with Blue Spike as Universal Music Battle Continues

Warner Music Group (WMG) has reached a settlement with Blue Spike in their patent infringement lawsuit, while Blue Spike's separate case against Universal Music Group (UMG) continues.

The settlement resolves Blue Spike's claims that WMG infringed on four data-protection patents through their Master Quality Authenticated (MQA) partnership, which was established in 2016 to deliver HD audio to listeners. Blue Spike, a Texas-based company holding over 100 patents, played a pioneering role in digital watermarking and early software development with major music labels.

Judge Jesse M. Furman dismissed the WMG case without costs and provided a 60-day window for Blue Spike to reopen the action if the settlement isn't finalized. The specific terms remain confidential.

Meanwhile, Blue Spike's lawsuit against UMG faces ongoing challenges. In May 2024, Blue Spike requested a 180-day extension, citing difficulties obtaining basic information about UMG's use of the MQA encryption system. The company claims UMG disclosed having "virtually no information about MQA" and that relevant data is held by undisclosed third parties, some located overseas.

Recent developments include:

  • The judge approved the extension request
  • A scheduling conference is planned for later this month
  • Blue Spike demanded to examine UMG's MQA file encryption computer on September 5th
