The lawsuit centers on a patent describing a method for selecting songs based on mood correlation between different tracks. The technology compares moods across songs using multiple identification techniques to establish similarities.
BMG Synch, the service in question, is a digital platform that enables clients to license music for synchronization purposes, offering a comprehensive catalog of tracks across various genres with search and preview capabilities.
Aperture Investments LLC, which holds approximately 15 active or pending patents related to music categorization and organization, is listed as the patent assignee.
The case follows similar patent infringement lawsuits filed by Blue Spike LLC against Warner Music Group and Universal Music Group in 2023, which focused on digital content encoding and distribution patents.
In a separate filing, Muvox is also suing IBM over their AI-powered music platform that analyzes and reproduces music based on mood identification, claiming it infringes on the same patent.
