The lawsuit claims the defendants "knowingly produced, possessed, and advertised commercial child pornography" through the album cover. Elden seeks compensation for alleged "extreme and permanent emotional distress" and "lifelong loss of income earning capacity."
A convicted sex offender named Timothy Fredrickson attempted to intervene in the case as a defendant. Fredrickson claims to own physical and digital copies of Nevermind and argues he has a "property interest at stake" should there be an "adverse ruling." His motion cites concerns about possessing the album artwork and his ability to travel interstate while listening to the music.
The court rejected Fredrickson's filing due to procedural deficiencies, including missing contact information and improper notice of motion.
Dave Grohl has indicated that Nirvana might consider changing the Nevermind cover, despite the album being over 30 years old.
