Madonna and her concert promoters are seeking dismissal of a class-action lawsuit filed over late concert start times at her December 2023 Barclays Center performances in New York City.

Two plaintiffs claim they suffered damages when Madonna's shows, advertised to begin at 8:30 PM, didn't start until after 10:30 PM and ended past 1:00 AM. They argue this caused transportation issues and that they wouldn't have purchased tickets had they known about the delayed start times.

The defense team argues several key points:

  • Concert-goers should reasonably expect doors to open at the ticketed time, with opening acts performing before the headliner
  • The plaintiffs acknowledged Madonna's history of late start times
  • No specific injuries or transportation difficulties were proven
  • The plaintiffs may be subject to Ticketmaster's arbitration clause

Madonna's legal team maintains that attendees "got just what they paid for: a full-length, high-quality show by the Queen of Pop." They're also seeking information about where tickets were purchased, as this could affect whether the case must go to arbitration under Ticketmaster's terms of use.

The defense questions whether the plaintiffs actually suffered any damages, noting they described the concert as "incredible" and failed to document specific transportation costs or difficulties getting home.
